Abortion Wasn’t the Winner That Democrats Wanted – So It’s Time to Bring in the Lawyers

Leftist media anchors and voters undertook a great deal of soul-searching in the wake of the devastating election loss for the Democrat Party. Some blame sexism, racism, both, or neither, but there’s one specific issue under evaluation: abortion, and how it wasn’t the slam dunk the Democrats thought it would be.

But don’t take our word for it; according to reporting from the New York Times, ““It is the only thing we’re really talking about,’ Nan Whaley, the Democratic nominee for governor in Ohio, said in her 2022 campaign. ‘We think it is the issue.’ Three weeks later, Whaley lost to Gov. Mike DeWine, a Republican who had signed abortion restrictions into law, by 25 percentage points.” 

Does that mean we can wave the issue of abortion goodbye? Far from it – in fact, it’s likely only going to get worse in some regards. The short version is that we all end up in court – a lot.  

As we wrote last year, no one quite knows how to call their lawyers like the abortion industry 

And it appears that will be true again heading into 2025. Here are a few examples of what’s likely to take us there: 

 

STATE ABORTION LAWS 

Whether abortion was defeated on the ballot in the November election or was already established as state law before then, we knew some states’ pro-life laws won’t be allowed to maintain their status quo. Indeed, already one week out from the election, the state of Kentucky is already facing a lawsuit for its excellent, life-at-conception pro-life laws 

According to reporting from NBC News, “A woman in Kentucky who is seeking an abortion filed a lawsuit Tuesday that seeks to strike down the state’s near-total [law]. The suit, filed by a woman referred to in the documents as Mary Poe, alleges that two Kentucky abortion laws violate the state constitution’s rights to privacy and self-determination.” 

Meanwhile, in Florida, where a pro-abortion ballot initiative was defeated, new fights are already gearing up. According to the Tallahassee Democrat, “On election night, Rep. Anna Eskamani, D-Orlando, said ‘we’re not going anywhere.’ 

She said she plans to file legislation that will repeal the six-week abortion law.” 

News flash for the Democrats – we’re not going anywhere either.

DEFUNDING AND DEBARRING PLANNED PARENTHOOD 

Even though Planned Parenthood sits on a mountain of cash like a Tolkien-esque dragon sits atop a mountain of gold coins, the abortion industry gets billions of dollars from taxpayers. Yet, these days could soon come to an end.  

During the election cycle, Vice President-elect J.D. Vance said that a future Trump administration would defund Planned Parenthood, saying, “’On the question of defunding Planned Parenthood, look, I mean our view is we don’t think that taxpayers should fund late-term abortions,’ Vance said after Trump’s rally in Butler, Pennsylvania. ‘That has been a consistent view of the Trump campaign the first time around. It will remain a consistent view.’” 

Do you think that won’t get a legal challenge? You’d better believe it will – Planned Parenthood is not going to go quietly if a sizable portion of their money vanishes.

CHEMICAL ABORTION PILLS 

Where do we begin with this one? 

How about a fight over The Comstock Act? Prohibitions against mailing contraception were dropped by the Biden-Harris administration, sometimes after previous court cases.  

Enforcing The Comstock Act would also weaken shield laws in pro-abortion states, which are (in essence) designed to circumvent existing laws in other states where abortion is illegal. Both of these issues are crucial when it comes to stopping the mailing of Chemical Abortion Pills.

How about another fight of these lethal drugs at the U.S. Supreme Court? Also likely, according to reporting from the New York Times, which says “revised lawsuit were filed this month by the conservative state attorneys general of three states — Missouri, Idaho and Kansas — against the Food and Drug Administration in the same federal district court in Texas as the original case. It seeks to reverse numerous regulatory changes the F.D.A. has made since 2016 that greatly expanded access to mifepristone.”

And then there’s the likely fights and countersuits by rights groups and state attorneys if the Trump-Vance administration get the EPA and FDA to do the required testing before allowing further distribution of Chemical Abortion Pills. Goodness knows states like New York and California won’t tolerate the federal government enforcing any law, climate related or not, that infringes upon unrestricted abortion for any reason.  

 

Thankfully, regardless of whether the battle is in the courtroom or the state house or the halls of Congress, SFLAction has a plan: a siege engine against the pro-abortion industry and the Democrats, taking the form of the Make America Pro-Life Again Roadmap. 

This legislative package will work in concert with our legal and cultural pursuits to limit and eliminate a method and means of deadly abortion pills shown to be a risk to both mother and child – something that state and federal governments can still address, even with abortion enshrined in some state constitutions.
